1. Who we are
JMT Sanitation LLC ("JMT", "we", "us", "our") is a Michigan limited liability company providing residential and business waste, Pink Bag pay-as-you-throw, and bulk garbage pickup services in Emmet County, Michigan. Our federal motor-carrier identifier is USDOT 4358682. Our mailing address and phone number are listed at the bottom of this page.
2. Acceptance and changes
By accessing or using jmtsanitation.com, submitting a contact form, calling for service, or signing up for any JMT service, you agree to these Terms and to our Privacy Policy and Cookie Policy. If you do not agree, please do not use the site or our services.
We may update these Terms. The new version takes effect when posted with an updated date. If a change is material to a customer relationship (price, scope, cancellation rules), we will give you at least 30 days notice by email or on the homepage before it takes effect for existing customers.
3. Eligibility
You must be at least 18 years old (or the age of majority where you live) to submit a service request. If you are signing up on behalf of a business, organization, household, or property, you confirm that you have the authority to bind it to these Terms.
4. The website
We provide the website "as is" and may change features, content, schedules, route maps, and pricing pages at any time without notice. When you visit the site you agree:
- Not to scrape, crawl, or otherwise access the site at a rate that hurts performance for other visitors.
- Not to submit false inquiries, malware, scripts, or anything illegal or designed to interfere with the site.
- Not to attempt to bypass security measures, rate limits, or admin authentication.
- Not to use the site to harvest data, build a competing dataset, or train any machine-learning model on its contents without our written permission.
- Not to misrepresent your identity or affiliation with any person or entity.
Information on the site is provided in good faith but may change. Schedules, pricing, and service areas in your signed agreement or written confirmation control over anything on the site if they conflict.
5. Service signups, scheduling, and cancellation
Submitting the contact form is a service request, not a contract. A service relationship begins when we confirm start, pickup day, and pricing in writing (email is fine), drop off a tote, or begin a route on your behalf, whichever comes first.
Pickup days, holiday adjustments, and route changes are communicated by email or phone. We aim to give at least 48 hours notice for any change we initiate. Severe weather, mechanical failure, illness, accidents, and other events beyond our reasonable control may delay or interrupt a route — we will do our best to make up missed pickups on the next available route day at no extra charge, but we are not liable for the delay itself.
No long contracts. You can cancel residential or business tote service at any time by emailing or calling us. We will pick up the JMT-owned tote at no charge on a normal route day after you cancel. Outstanding amounts owed at the time of cancellation remain due.
6. Pricing, billing, and payment
Current pricing is shown on each service page. Prices may change for new customers at any time and for existing customers with at least 30 days written notice. Pink Bags are sold at retail partners at the prices listed by each retailer; JMT does not control retail pricing.
We accept credit cards through our third-party payment processor. By providing payment information you authorize us (and our processor) to charge the amount due. Card numbers are not stored on JMT systems.
Past-due balances may be subject to a reasonable late fee and, after written notice, suspension of service until the balance is paid. We do not report unpaid balances to credit bureaus for individual residential customers; commercial accounts may be referred to a collections agency after 90 days past due.
7. Acceptable use of pickup services
JMT picks up household and ordinary commercial waste. You agree to not place any of the following in or around a JMT tote, Pink Bag, or bulk pickup load:
- Hazardous waste (paints, solvents, oils, gasoline, antifreeze, batteries other than household alkaline);
- Biomedical or sharps waste (needles, lab waste, drugs);
- Asbestos, lead-paint debris, or any other regulated environmental hazard;
- Tires (except where pre-arranged), propane tanks, oxygen tanks, or other pressurized cylinders;
- Liquid waste, sewage, or septage;
- Dead animals or hunting waste;
- Material that exceeds posted weight limits for the container being used;
- Anything otherwise prohibited by federal, state, or local law.
If we discover prohibited materials, we may refuse the pickup, return the material to your address, charge a special-handling fee equal to our cost plus a reasonable margin, and report the violation to the appropriate authorities. You are responsible for any fine, cleanup cost, or third-party claim resulting from prohibited materials you placed for pickup.
8. Totes and equipment
Totes provided by JMT remain JMT property. You agree to keep the tote at the service address, use it only for its intended purpose, and not paint, modify, or transfer it. You are responsible for replacement cost (at our actual cost) if the tote is lost, stolen, or damaged beyond ordinary wear and tear while in your custody. Damage caused by JMT, our agents, or normal route use is on us.
9. Photos and other content you submit
When you submit photos or other content through the contact form or by email, you keep ownership. You grant JMT a worldwide, royalty-free, non-exclusive license to use that content for the limited purpose of quoting, scheduling, performing, and documenting the work. We will not publish your photos in marketing without your separate consent. You represent that you have the right to share the content and that it does not infringe any third party's rights.
10. Intellectual property
The JMT Sanitation name, logo, raccoon mascot, the "Pink Bag" program name, the site design, and the site content are owned by JMT or its licensors and are protected by trademark, copyright, and other intellectual property laws. You may not use any of them without our written permission, except for the limited fair-use right to reference JMT by name when describing our services.
11. Third-party services and links
The site uses Vercel for hosting, Supabase for data storage, Resend for email delivery, and Mapbox for address autocomplete. The site may link to third-party websites. We are not responsible for the content, privacy practices, or availability of third-party services or sites, and a link is not an endorsement.
12. Disclaimer of warranties
Please read this section carefully.
THE SITE AND ALL CONTENT, MATERIALS, INFORMATION, AND TOOLS ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR ACCURATE. WHILE WE WORK TO KEEP ROUTES RELIABLE, WE DO NOT WARRANT THAT ANY PARTICULAR PICKUP WILL OCCUR AT A PARTICULAR TIME OR WITHOUT DELAY. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, JMT SANITATION LLC AND ITS OWNERS, MEMBERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITE OR OUR SERVICES, REGARDLESS OF LEGAL THEORY, IS LIMITED TO THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO JMT FOR SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Nothing in these Terms limits liability that cannot be limited under applicable law (for example, liability for gross negligence, intentional misconduct, or fraud), or any liability that JMT's commercial liability insurance is required to cover. Some states do not allow the limitation or exclusion of incidental or consequential damages, so some of the above may not apply to you.
14. Indemnification
You agree to defend, indemnify, and hold harmless JMT Sanitation LLC and its owners, members, employees, and contractors from and against any claim, demand, loss, damage, fine, fee (including reasonable attorney fees), or expense arising out of or related to: (a) your violation of these Terms; (b) your violation of any law or third-party right; (c) prohibited materials placed in or around a JMT container or for bulk pickup by you or anyone using your service; (d) content you submit through the site; or (e) your misuse of the site. We will give you prompt written notice of any claim, reasonable cooperation in the defense, and the right to control the defense and settlement (provided we will not settle in a way that admits fault on your part without your consent).
15. Force majeure
We are not liable for any delay or failure to perform caused by circumstances beyond our reasonable control, including severe weather, fire, flood, road closures, fuel shortages, supply-chain disruptions, pandemics, labor disputes, vehicle breakdowns, government action, or acts of third parties.
16. Governing law and venue
These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. The U.N. Convention on Contracts for the International Sale of Goods does not apply. Any dispute that cannot be informally resolved will be brought exclusively in the state or federal courts located in Emmet County, Michigan, and you consent to personal jurisdiction and venue there.
17. Informal resolution first
Before filing any lawsuit, you agree to send a written notice of the dispute to jmtsanitation@gmail.com describing the issue and what you'd like as a resolution. We will respond within 30 days and try in good faith to resolve the dispute without litigation. This step is required for both sides.
18. Termination
We may suspend or terminate your access to the site, or your service, at any time for any reason including violation of these Terms, non-payment, prohibited materials, or threatening behavior toward our staff. Sections 7–14, 16, 19, 20, and 21 survive termination.
19. Severability and waiver
If any part of these Terms is held to be unenforceable, the rest stays in effect, and the unenforceable part is modified to the minimum extent necessary to make it enforceable, preserving the original intent as closely as possible. Our failure to enforce a provision is not a waiver of that provision or any other.
20. Assignment
You may not assign or transfer these Terms or any rights under them without our written consent. We may assign these Terms to a successor in connection with a merger, acquisition, financing, or sale of substantially all of our assets, without notice or your consent.
21. Entire agreement
These Terms, together with any signed customer agreement, written quote, or service confirmation, and our Privacy Policy and Cookie Policy, constitute the entire agreement between you and JMT regarding the site and our services, and supersede any prior agreement on the same subject.
22. Notices
Legal notices to JMT must be in writing and sent to jmtsanitation@gmail.com or by mail to the address below. We will send notices to you at the email or service address you provided most recently.
